3 MathReader is licensed free of charge, subject to certain terms and
4 conditions.

6MathReader License Agreement

8 Pursuant to this Limited License Agreement ("Agreement") WRI grants
9 you ("Licensee"), free of charge, a non-exclusive, perpetual license
10 to use, copy, and distribute MathReader ("the Program") for the
11 purpose of enhancing the Mathematica^(R) interoperability of certain
12 Licensee products and services ("Licensee Work"); provided that such
13 use or distribution does not violate the terms of this Agreement.

15 1. Program Use

17 Licensee can download, install, and use the Program. Licensee is
18 permitted to distribute the Program for non-commercial purposes,
19 provided that this Agreement is included with each such copy
20 distributed. Any person or entity who obtains or uses a copy of the
21 Program under or through this Agreement agrees to be bound thereby.

23 Licensee may only distribute the Program in its entirety. Licensee may
24 distribute the Program commercially, but only in conjunction with
25 Licensee Work and provided that Licensee does not charge a fee for
26 Program; rather, the Program must be included as a "bonus" item
27 packaged with Licensee Work. If such Licensee Work contains code or
28 instructions written in the Mathematica language, Licensee agrees to
29 include with Licensee Work a statement that Mathematica is required to
30 execute the code or instructions. In addition, Licensee agrees to
31 appropriately identify and attribute any WRI trademarks contained in
32 the Licensee Work or associated documentation. For example: the first
33 appearance of the word "Mathematica" in a textual setting, or the most
34 prominent use of the word in a graphical setting, should be
35 accompanied by the superscript "(R)" symbol.

37 Licensees may contact WRI Legal Administration at info@wolfram.com
38 for specific instructions on the use of WRI trademarks in Licensee
39 Works.

41 Licensee may only use WRI trade names and trademarks for the purpose
42 of naming WRI products described by said trademarks.

44 2. Ownership

46 The Program and related user documentation, if any, are proprietary
47 products of WRI, and are protected under U.S. and international
48 copyright law. All right, title, and interest in and to the Program,
49 including associated intellectual property rights, are and shall
50 remain with WRI. This Agreement does not convey to Licensee an
51 interest in or to the Program, but only a limited right of use
52 revocable in accordance with the terms of this Agreement.

54 3. Restrictions

56 Licensee agrees not to reverse assemble, reverse compile, or otherwise
57 translate or modify the Program in whole or in part. Licensee may not
58 use, copy, modify, or distribute the Program (electronically or
59 otherwise), or any copy, adaptation, transcription, or portion
60 thereof, in whole or in part, except as expressly authorized by this
61 Agreement.

63 4. No Warranty

65 The Program is being delivered AS IS and WRI makes no warranty as to
66 its use or performance. WRI AND ITS SUPPLIERS DO NOT AND CANNOT
67 WARRANT THE PERFORMANCE OR RESULTS LICENSEE MAY OBTAIN BY USING THE
68 PROGRAM. WRI AND ITS SUPPLIERS MAKE NO WARRANTIES, EXPRESS OR IMPLIED,
69 AS TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR
70 FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT WILL WRI OR ITS
71 SUPPLIERS BE LIABLE TO LICENSEE FOR ANY CONSEQUENTIAL, INCIDENTAL, OR
72 SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF A
73 WRI REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
74 DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.

76 Some states or jurisdictions do not allow the exclusion or limitation
77 of incidental, consequential, or special damages, or the exclusion of
78 implied warranties or limitations on how long an implied warranty may
79 last, so that all or some of the above limitations may not apply to
80 all Licensees.

82 5. Governing Law

84 This Agreement will be governed by the laws of the State of Illinois,
85 U.S.A., without giving effect to its rules the application of its
86 conflicts of law rules. Application of the United Nations Convention
87 on Contracts for the International Sale of Goods is expressly
88 excluded.

90 6. Waiver, Severability, and Merger

92 The failure of either party to enforce any rights granted hereunder or
93 to take action against the other party in the event of any breach
94 hereunder shall not be deemed a waiver by that party as to subsequent
95 enforcement of rights or subsequent actions in the event of future
96 breaches. If any part of this Agreement is found void and
97 unenforceable, it will not affect the validity of the balance of the
98 Agreement, which shall remain valid and enforceable according to its
99 terms. This Agreement is the full and final expression of the intent
100 of the parties with respect to the subject matter herein; this
101 Agreement supersedes any prior or contemporaneous discussions,
102 agreements, or representations by or between the parties hereto.

104 7. Export

106 Licensee agrees not to ship or otherwise permit distribution of the
107 Program into any country or for any use prohibited by the United
108 States Export Administration Act or any other export laws,
109 restrictions, or regulations.

111 8. Term and Termination

113 This Agreement is effective upon Licensee's execution of this
114 Agreement, and shall continue in effect until terminated. WRI may
115 terminate this Agreement immediately in the event of any breach by
116 Licensee of any term hereof. Upon such termination by WRI, Licensee
117 agrees to destroy all copies or portions of the Program under its
118 control, and to cease any distribution of the Program immediately upon
119 notification of termination by WRI.
